Pres. Aquino's speech regarding SC's decision on Truth Commission legality

Pahayag

ni

Benigno S. Aquino III

With many people wanting to get more decent investigation of graft/corruption in GMA administration, why didn’t Noynoy get much better lawyers to write EO-Number1? He can not say that he was blindsided and he was surprised. He has been receiving warnings (from Miriam Santiago and Joker Arroyo, among others) that a kangaroo-court approach to Truth Commission will be rejected and that Pilipinas has rules and constitutional technicalities that deail with this matter. Too bad. There is a price to pay for sloppiness and laziness. The poor quality of paragraphs in ExecutiveOrder#1 were what the Supreme court ruled against. Noynoy mentions “justice delayed” above, but Malacanang-legal-team not working painstakingly enough is among the reasons for the rejection.

    • Bert

The Truth Commission is not created as a “court” nor is it a “kangaroo-court”. And Mirriam and Joker, as the Supreme Court justices, are Arroyo’s supporters.

Maybe next year, Noynoy loses his patience that he makes an Executive Order, and in one fell swoop, he removes all Arroyo-appointees in Pilipinas Supreme Court and appoints judges and lawyers who are beholden to him or Cory. Magawa kaya ito ni Noynoy? Siguro naman, hindi, ano? Even Bongbong would not be that daring, si Noynoy pa?
        —————
This is all so wrong to have Supreme Court justices just picked by the sitting President. Why doesn’t Pilipinas copy USA where Senate confirmation is required for supreme-court nominees? If not that, then maybe Pilipinas should have it where the President can only choose from a list of names prepared by, say, a judicial bar council consisting of respected legal names (e.g. with members to include a representative of the private sector, a representative from Congress, a respected law-professor, a former justice of supreme court, etcetera).

        • Bert

If the justices continue to be dummies, Congress can do it…then approve appointed judges and lawyers that are beholden to the Constitution, and not to one person.

This is my very own personal opinion, Bert, but in my heart, I think that Noynoy suspects that TruthComm will fail.

Noynoy senses that there are no court-admissible evidence to convict GMA. The reason I say this is Noynoy’s choice of Hilario Davide, Jr. When it happens that TrutComm fails in its mission to convict GMA, then Hilario Davide Jr becomes the fall-guy. Hilario Davide Jr (who swore GMA in to replace Erap and who GMA appointed to United Nations) will be fall-guy, another GMA-protector in high places, the one who was not hard-working enough and inventive enough to convict GMA. Malacanang may even strip him of his retirement benefits!

          • Bert

I think so, too, UP n. And just to be clear about it, and you might not believe this, but I personally don’t want GMA to get jailed. She had suffered a lot already for all those things that happened in her 9-year rule. Just thinking of her sons and daughter and all of her grandchildren and future grandchildren reading in the internet and other media those public vilifications of her and crimes attributed to her elicited already sympathy with the former president within me. I think it’s sufficient punishment already.

But I want those government officials who served in her administration rot in jail for all their heinous crimes.

Should GMA get convicted of bribery or similar, then jail would be appropriate penalty. [Mar Roxas (or whoever is president after Noynoy) can issue a pardon later…. maybe.]

    ito pla:

    http://sc.judiciary.gov.ph/jurisprudence/2010/toc/december.htm

reading it briefly, this struck me.

“The Court tried to seek guidance from the pronouncement in the case of Virata v. Sandiganbayan,[106] that the “PCGG Charter (composed of Executive Orders Nos. 1, 2 and 14) does not violate the equal protection clause.” The decision, however, was devoid of any discussion on how such conclusory statement was arrived at, the principal issue in said case being only the sufficiency of a cause of action.”

this is weird to me. the pcgg is so similar to the ptc, but the pcgg doesnt violate…

  • GabbyD

if anyone can find the text of the decision, it would be great to share. thanks.

GabbyD: Did you read the text of the Supreme Court decision?

Had Noynoy legal team included investigation of FVR (power-contracts) and Marcos (Bataan nuclear plant; Ninoy Aquino murder mastermind(s) ) then EO#1 would have had a better chance of being constitutionally compliant.

Is there any doubt now why President Noynoy’s popularity is soaring?
