The architect of the Garcia plea-bargain was served with a three-month preventive suspension order signed by Executive Secretary Paquito Ochoa.

Special Prosecutor Wendell Barreras-Sulit was charged with graft and betrayal of public trust for failing to pursue the plunder charge against Gen. Garcia “with utmost responsibility, integrity and professional competence” thus causing “undue injury to the government and gave unwarranted benefits to Garcia through manifest partiality, evident bad faith and gross inexcusable negligence.”

Malacanang said that Sulit dropped the case “by ignoring and abandoning evidence favorable to the interest of the government and presenting evidence adverse to its cause.” In addition, she also “knowingly and willfully” violated rules and jurisprudence when she agreed to the plea bargain.

Sulit had no comment for the media on the her suspension. She did jot down a marginal note on the suspension order: “received under protest subject to outcome of my petition in the Supreme Court and in view of the pendency thereof.”

I guess that means she’s going to tough it out.

    I am confused by the organizational structure with this Ombudsman-office thing.
    Malacang has responsibility for the deputy-ombudsmen, right? Responsibility equal to “I will hire them, I will evaluate them, I will fire them”, when they go bad, the buck stops with me.

    I know that Merci believes otherwise — that the hire-fire is with her, not with Malacanang.

      I hope the case — or cases, the first case is with that Dude and Quirino-grandstand-your-fault that Noynoy puts onto the Deputy Ombudsman’s feet. I hope the cases get to Pilipinas Supreme Court.

      If Deputy Ombudsmen are Malacanang’s responsibilities, then the Deputy should report to deLima or even to Ochoa.

      The language of the Ombudsman law is clear. However, lawyers will interpret it as it suits them.

        Presi-Noynoy’s lawyers interpreted the language of “guilty unless proven innocent”, good thing Presi-Noynoy had presence of mind to hold back the PNP and military from exercising what his lawyers had told him about Truth-Commission – Executive Order 1.

        Had Presi-Noynoy said Executive-Branch could fire a non-performer employee of Congress — Jinggoy’s or bongbong or Villar or Mikey Arroyo’s employee — Congress would have reacted — “separation of constitutional bodies” — and I doubt that Enrile would say Malacanang, when displeased, can fire government employees working at Congress.
